Paul Miller

Paul Miller began practicing law in 1983 and became affiliated with the firm in 1991. He obtained Board Certification in Personal Injury Trial Law from the Texas Board of Legal Specialization in 1990, and with well over 100 jury verdicts to his credit, he has held the rank of “Advocate” with the American Board of Trial Advocates since 1998. He now serves as the firm’s lead personal injury, medical malpractice, and defense litigation counsel.

Texas State Court:

• Defended and resolved fall-from-height death claims brought against an industrial maintenance supply contractor who removed sections of catwalk to perform maintenance at a power generation plant (case 1) and at a cement production facility (case 2).
• Defended and resolved a fall-from-height traumatic brain injury claim brought against a national construction company acting as a general contractor on a large high-rise apartment project brought by a subcontractor’s employee.

Premises Liability

Texas State Court:

• Obtained a unanimous defense verdict on behalf of a national senior independent living facility in a claim brought by the family of a resident who fell in the facility and later died.
• Obtained a summary judgment on behalf of a regional grocery chain on claims arising from a parking lot trip and fall that resulted in a broken hip.

Arkansas State Court:

• Obtained a unanimous defense verdict on behalf of a regional grocery chain sued as a result of an in-store slip and fall.

Texas & Arkansas State Courts:

• 50+ defense verdicts in premises liability claims brought against retail businesses.

Product Liability

Texas Federal Court:

• Obtained a dismissal without payment on behalf of an oil field pump manufacturer who was sued for multiple millions of dollars for economic damages due to an alleged faulty pump.

Texas State Court:

• Obtained a voluntary dismissal without payment of an oil field valve manufacturer in a claim arising from the death of a 23 year old oil field worker who was killed when the client’s valve separated under pressure.
• Reached a favorable settlement on behalf of an oil rig designer/manufacturer on a claim brought by a oil rig worker who suffered the traumatic amputation of a leg at the hip when a 1,000-pound piece of equipment fell from the rig.
• Defended a pulpwood trailer designer/manufacturer and successfully resolved a negligence and product liability claim for catastrophic injury brought by an elderly couple that drove underneath the defendant's trailer that had hung up on a farm to market road due to the landing gear digging into the pavement.
• Defended the manufacturer/fabricator of a plasma table that exploded during a cutting operation and caused the death of a 28-year-old manufacturing plant worker.

Arkansas State Court:

• Negotiated a favorable settlement of behalf of a trailer coupler/hitch manufacturer in a wrongful death claim arising from the death of a 16-year-old plaintiff killed when a boat and trailer released from an oncoming vehicle.

Transportation / Wrongful Death

Texas State Court:

• Defended a timber operator and successfully resolved a wrongful death claim brought on behalf of an undocumented worker who died when his vehicle struck logs spilled on a highway due to a rollover caused by overloading.
• Defended and resolved without payment a wrongful death claim against an industrial business that had rented a lift truck to a freight packing company located at Bush Intercontinental Airport.
• Negotiated a favorable settlement of a wrongful death claim brought against a large retailer whose regional manager struck and killed a high school student riding a bicycle across a long causeway in pre-dawn darkness.

Arkansas State Court:

• Negotiated a favorable settlement of a wrongful death claim on behalf of a utility service company whose truck skidded on ice while responding to widespread electric power outage and struck and killed a young nursing student who had pulled over and stopped due to icy conditions.

Civil Rights Defense

Texas Federal Court:

• Obtained a unanimous defense verdict on behalf of a national private correctional corporation, a city police department, and a county sheriff involving plaintiff’s constitutional claims made under Section 1983.
• Obtained a mid-trial voluntary dismissal of racial discrimination claims brought by a sheriff’s deputy against the county and the elected sheriff.
• Obtained a unanimous defense verdict on behalf of an elected sheriff on claims of violation of civil rights of arrestee.
• Obtained defense verdict on § 1983 illegal search and wrongful arrest claims brought against task force officers.

Food Safety

Texas State Court:

• Successfully defended a regional grocery chain and resolved through minimal settlement a claim brought by a customer who alleged e. Coli poisoning.

Medical malpractice

Texas Federal Court:

• Obtained defense verdict on behalf of a rehabilitation hospital on claims of wrongful death, medical malpractice, and long-term illness due to pressure ulcers.

Texas State Court:

• Obtained a summary judgment on behalf of a pharmacy and pharmacist accused of failing to provide complete, current patient information and warnings regarding Ambien.
• Obtained defense verdict on behalf of a continuing care hospital on claims of medical malpractice and long-term illness due to development of pressure ulcers.

Arkansas State Court:

• Negotiated a minimal settlement on behalf of an Arkansas hospital that was sued for medical malpractice and wrongful death by the family of a middle-aged man who died of a heart attack one hour after being discharged from the hospital emergency department for treatment of nausea/heartburn.
• Resolved through minimal settlement claims of medical malpractice and wrongful death against a continuous care hospital arising from treatment of a catastrophically injured elderly patient who developed a pressure wound.

Texas State & Federal Courts:

• Multiple defense verdicts in medical malpractice cases filed against hospitals and hospital personnel.
